In compliance with the stipulations listed in Law 19/2013 of 9 December, regarding transparency, access to public information, and good governance, Sevilla Fútbol Club hereby makes the following information available to the public:

Institutional, organisational, and plannning information

Introduction

Article 6 of Law 19/2013 of 19 December, regarding transparency, access to public information, and good governance, under the heading “Institutional, organizational, and planning information,” states the following:

“1. Subjects understood to fall within the area of application of this law will publish information regarding their operations, applicable legislation, as well as organizational structure. For this purpose, they will include an up-to-date organizational diagramme identifying the people in charge of different divisions, their profile and career.”

For this reason, we are fully complying with the above mentioned stipulations by listing the operations carried out by SEVILLA FÚTBOL CLUB, as per Section 2, firstly listing their nature and legal framework in order to secondly describe the different operations carried out by the organization in accordance with applicable legislation.  Then we will reference the applicable legislation, as per Section 3, and will describe our organizational structure, Section 4.

Operations carried out by the Club S.A.D.

Under the name of “SEVILLA FÚTBOL CLUB SOCIEDAD DEPORTIVA, S.A.D.,” a Public Limited Sports Company was founded, with indefinite character, whose activities and operations consist of:

1. Participation in official football competitions of a professional nature at the national level.

2. The promotion and development of sporting activities of one or various types of sport, and participation in corresponding competitions.

3. The commercialization and operation of sporting events, products, and rights connected to the sporting activities, professional team, and team media.

All of these activities may be carried out to a full or partial extent, indirectly through affiliated Companies to which the Company provides shares or any type of participation that has an identical or similar purpose.

Financial, budget, and statistical information

Introduction

Article 8 of Law 19/2013 of 9 December, regarding transparency, access to public information, and good governance, under the heading “financial, budgetary, and statistical information,” in the section applicable to the Club/Company, requires that organisations falling within the scope of this law must make public, at minimum, the information regarding acts of administrative management with financial or budgetary repercussions, indicated as follows:

“a) All contracts, indicating the purpose, duration, bid and allocation amounts, the procedure utilized for assigning the contract, the instruments through which it was advertised, the number of bidders participating in the process, and the identity of the people responsible for allocating the contract, as well as any modifications to said contract. Additionally required for publication are cancelled or broken contracts. The publication of information in regards to minor contracts can be carried out every trimester. …

b) All signed agreements, mentioning signing parties, purpose, duration, modifications, derived responsibilities, and corresponding financial obligations if applicable. Additionally, any signed management agreements, indicating their purpose, budget, duration, financial obligations, and sub-contracts including those responsible for their allocation, the procedure followed, and amount

c) Subsidies and public aid received, indicating the amount, purpose, and beneficiaries

d) Budgets, describing the principle budgetary divisions as well as up-to-date and clear information regarding their status.

e) Annual accounts and auditing or oversight reports provided by the external inspection body carrying them out.

f) Annual compensation received by upper management of the companies included in the scope of this law. Similarly, severance compensation will also be made public if applicable.

2. . The subjects mentioned in Article 3 must publish the information to which headings a) and b) of the first section of this article refer when regarding contracts or agreements made with a Public Administration. Similarly, it will be necessary to publish the information listed under heading c) in regards to subsidies originating from a Public Administration.”

For this purpose, the information regarding contracts and agreements signed by the Club/Company and subsidies received from the Public Administration is listed here, as per sections 2, 3, and 4. Additionally provided is the documentation regarding budgets and annual accounts, including the amounts received by senior members of management, as per sections 5, 6, and 7.

Sevilla Fútbol Club S.A.D. is not undergoing any type of bankruptcy procedures.

In accordance with the stipulations of Article 8 a) of Law 19/2013 of 9 December, regarding access to public information and good governance, we will specify any public contract agreements that involve the Club/Company

Agreements

In accordance with the stipulations of Article 8 b) of Law 19/2013 of 9 December, regarding access to public information and good governance, we will specify any public contract agreements that involve the Club/Company:

  • Currently, Sevilla Fútbol Club has no such agreement with the Public Administration.

Public subsidies

In accordance with the stipulations of Article 8 c) of Law 19/2013 of 9 December, regarding transparency, access to public information, and good governance, the following public aid and subsidies are listed, indicating their amount, purpose, and beneficiaries:

  • Liga Nacional de Fútbol Profesional (National Professional Football League); for the adaptation of sports infrastructure for compliance with violence-prevention rules found in R.D. 419/1991 of 27 March, which regulates the distribution of collection and prizes in State sports betting, and subsequent modifications (R.D. 258/1998, R.D. 98/2003, and R.D. 566/2010). 2013-14 Season: €163,650 2014-15 Season: €254,119.04€ 2015-16: €257,691.22

 

  • National Professional Football League, received through the R.F.E.F. Y F.A.F.; Amateur categories. 2013-14 Season: €19,213.45 2014-15 Season: €14,763.23€ 2015-16 Season: €15,949.10

 

  • Fundación Tripartita para la Formación en el Empleo (Tripartite Foundation for On-site Training); €22,784.96 (2013/2014); bonuses for Social Security contributions, related to carrying out courses directed towards improving professional skills. 2013-14 Season: €22,784.96€ 2014-15 Season: €23,892.51 2015-16 Season: €25,752.30

Budgets

In accordance with the stipulations listed in Article 8 d) of Law 19/2013 of 9 December, regarding transparency, access to public information, and good governance, the following documentation therein referenced has been provided here.

 

(*) Includes Supplies, Non-Sporting Staff costs, the cost of Sporting Staff not able to be registered with the LFP, other operational costs, depreciation – not including intangible sporting assets, other income, allocation of subsidies, financial results, and a safety margin of 3,000,000 euros.

Annual accounts and auditing reports

In accordance with the stipulations found in Article 8 d) of Law 19/2013 of 9 December, regarding transparency, access to public information and good governance, copies are attached of the documents referenced therein:

Date of deposit in the Commercial Register of the annual accounts corresponding to the fiscal year concluding on 30 June 2015, 22/01/16.

Date of submission to the Sports Council (Consejo Superior de Deportes) of the annual accounts corresponding to the fiscal year concluding on 30 June 2015, 11/11/2015.

Date of dispatch, to the Liga de Fútbol Profesional (LFP) of the annual accounts corresponding to the fiscal year concluding on 30 June 2015, and other required economic-financial information, on 27/11/2015.

El ÍNDICE DE TRANSPARENCIA DE LOS CLUBES DE FÚTBOL (INFUT)

Transparencia Internacional España ha creado y publicado un Índice: El ÍNDICE DE TRANSPARENCIA DE LOS CLUBS DE FÚTBOL (INFUT), con el que pretende un doble objetivo: Por una parte, realizar una evaluación del nivel de transparencia de los Clubs de Fútbol, y por otra, impulsar y propiciar el aumento de la información que éstos ofrecen a los ciudadanos y a la sociedad en su conjunto

Las cinco Áreas de transparencia que se evalúan en el INFUT son las siguientes:

A) Información sobre el Club de fútbol;

B) Relaciones con los socios, aficionados y público en general;

C) Transparencia económico-financiera;

D) Transparencia en las contrataciones y suministros;

E) Indicadores de la Ley de transparencia.

Con la aplicación de ese conjunto de 60 indicadores, cada Club de fútbol/SAD obtiene una puntuación individual, de forma que surge un Ranking o Clasificación del nivel de transparencia de los Clubs/SAD evaluados.
